SALES AGREEMENT
Legal entities acting as buyers are subject to the provisions of the Civil Obligations Act and the Electronic Commerce Act and are not covered by the Consumer Protection Act.
These General Terms and Conditions apply to legal entities only in the parts that concern the main characteristics of the product, the process of concluding the contract, the product price, the method of payment and shipping, the description of delivery methods and costs, general information, warranty and service conditions, loyalty programs, disclaimers, and the moment of contract conclusion.
The seller may, at its sole discretion, grant a legal entity the same rights as those available to a consumer.
A user is any person who uses the website www.shegava.com, including every buyer and visitor of the site.
The conclusion of a sales contract through the website www.shegava.com
is regulated in accordance with legal provisions, taking into account the principles and provisions of the European Union directives.
Concluding a contract via www.shegava.com represents the conclusion of a distance contract.
These General Terms and Conditions also serve as pre-contractual information and apply to the conclusion of a sales contract when the buyer is a consumer — that is, any natural person who enters into a legal transaction or acts on the market outside of their trade, business, craft, or professional activity.
A contract is considered concluded between the trader and the consumer as part of an organized system for the sale of goods or provision of services without the simultaneous physical presence of both parties, and the contract is concluded exclusively through one or more means of distance communication.
Means of distance communication include all methods that can be used to conclude a contract without the simultaneous physical presence of the trader and the consumer, such as the Internet or electronic mail.
A contract is concluded when the seller accepts the buyer’s offer. All product listings on the shegava.com website constitute an invitation to submit offers.
The seller may terminate the sales contract if the buyer fails to pay the purchase price and is not obliged to deliver the product until payment has been received.
An integral part of these General Terms and Conditions is the General Data Protection Policy.
The content of the website www.shegava.com is available in the Croatian language. The official language for concluding sales contracts is Croatian.
MAIN PRODUCT FEATURES
The buyer can familiarize themselves with the main characteristics of each product on the website www.shegava.com.
3 kantuna reserves the right to change information, including product prices and promotional offers, on the website without prior notice.
Each product image is accompanied by a description of the main product features and its price, including VAT.
Prices, payment terms, and promotional offers are valid exclusively at the moment of placing and/or paying for the order.
CONTRACT CONCLUSION PROCEDURE
Purchases are made on the website www.shegava.com
by completing the designated online form. When filling out the form, the buyer is required to provide all requested information.
A purchase can be completed only after the buyer confirms that they have read, understood, and agreed to the General Terms and Conditions, and acknowledges that the order entails an obligation to pay.
Shopping is available 24 hours a day, 7 days a week.
3 kantuna is not responsible for any costs related to the use of computer equipment or telecommunication services necessary for accessing the website.
The buyer will be notified via email confirming receipt of their order (an electronic message containing the buyer’s offer) and the dispatch of the shipment.
If, for any reason, 3 kantuna is unable to deliver one or more of the ordered products, an employee of 3 kantuna will contact the buyer by phone or email to arrange a substitute product or the possible cancellation of the affected product.
Purchases on behalf of minors or persons deprived of legal capacity (fully or partially) may only be made by their legal representatives.
Purchases are made by ordering available products chosen by the buyer based on photos and brief descriptions.
Product photos are for illustrative purposes only and may not always fully correspond to the actual products.
The purchase process consists of a few simple steps, allowing the buyer to shop comfortably from their home or any other location worldwide.
Orders are placed electronically.
By clicking the “Add to Cart” button, the selected product is added to the shopping cart.
Adding a product to the cart does not mean the product is reserved, ordered, or purchased.
The buyer may continue shopping by clicking “Continue Shopping,” view their cart by clicking “View Cart,” or complete the selection process by clicking “Checkout.”
Upon clicking “Checkout,” the buyer will be redirected to a page where they can select the payment method, delivery method, enter a coupon or gift card code (if applicable), and add additional notes, such as a request for an R1 invoice.
The purchase cannot proceed without checking the box “I agree to the General Terms and Conditions,” confirming that the buyer has read, understood, and accepted them, and the box “I am aware that the order entails an obligation to pay.”
By clicking “Edit Cart,” the buyer may modify the cart contents.
If satisfied with their selection, the buyer can finalize the purchase by clicking “Pay.”
After placing the order by clicking “Pay,” the seller will send the buyer the General Terms and Conditions, an order confirmation, and the order number via email, confirming that the buyer’s order has been received and is being processed.
The seller will then send the buyer, via email, a confirmation that the sales contract has been concluded along with a notice that the shipment has been dispatched.
If the buyer does not receive the ordered products within 20 business days (excluding Saturdays, Sundays, and public holidays) from payment, or within 20 business days from the conclusion of the contract for cash-on-delivery payments, they must notify the seller via email at shegava@shegava.com.
If the buyer does not receive a purchase confirmation email within 72 hours or cannot access the service as described in the message, they are obliged to contact the seller at shegava@shegava.com.
If, for any reason, 3 kantuna cannot deliver one or more of the ordered products, a representative of 3 kantuna will contact the buyer by phone or email to arrange delivery of a substitute product or cancellation of the ordered item.
PAYMENT
The buyer can pay for products purchased on the website www.shegava.com
in the following ways:
By card payment via the CorvusPay system
(using Visa, Maestro, MasterCard, Diners, and Discover cards)
By bank transfer (payment slip or internet banking)
When selecting this payment method, the buyer will receive an order confirmation via email containing all the information necessary to make the payment.
Payments must be made within 3 business days of receiving the order confirmation.
After the payment is visible in the seller’s account, the ordered products will be dispatched.
If the payment is not received within 3 days, the order will be canceled automatically.
Cash on delivery (COD)
The buyer pays the courier the full order amount upon delivery.
Payments are made in euros (EUR).
The seller uses the CorvusPay system for secure online payment.
CorvusPay ensures complete confidentiality of card and personal data from the moment the buyer enters them.
Payment data are transmitted in encrypted form from the buyer’s computer directly to the authorization center of the card issuer.
At no time does the seller have access to the buyer’s card data.
The seller cannot store or access credit card numbers or other related information.
All product prices are expressed in euros (EUR) and include VAT.
Product prices do not include delivery costs unless otherwise specified.
Delivery costs are shown separately before the order is finalized.
Despite regular updates of product information, it may occasionally happen that price or stock data are inaccurate.
In such cases, 3 kantuna reserves the right not to fulfill the order and will notify the buyer accordingly.
DELIVERY
Delivery is carried out through GLS Croatia and the Croatian Post (Hrvatska pošta).
Products are shipped throughout the Republic of Croatia and abroad.
Delivery is made to the address specified by the buyer during the order process.
If the buyer is not present at the delivery address, the courier will leave a notice containing instructions on how to collect the shipment or arrange redelivery.
Products will be packaged in a way that prevents damage during normal handling in transport.
The buyer is obliged to check the condition of the shipment upon receipt.
If there are visible damages (e.g., a torn package), the buyer must immediately report the issue to the courier and refuse to accept the shipment.
In such cases, the buyer should contact the seller as soon as possible by email at shegava@shegava.com.
If the buyer fails to take delivery of the product or refuses to accept it without a valid reason, the seller reserves the right to claim reimbursement for delivery, handling, and return costs.
The delivery price is displayed in the cart before finalizing the order, and depends on the delivery destination and total package weight.
The estimated delivery time is:
2 to 5 business days within Croatia (after payment confirmation),
up to 20 business days for international deliveries.
If the product is temporarily out of stock, the seller will notify the buyer and inform them of the expected delivery time.
The buyer may then choose to wait, select a substitute product, or cancel the order.
Once the shipment is handed over to the delivery service, the buyer will receive an email notification confirming dispatch and, if applicable, a tracking number.
The seller is not responsible for delivery delays caused by force majeure, courier company issues, or incorrect information provided by the buyer.
RIGHT OF WITHDRAWAL (UNILATERAL TERMINATION OF THE CONTRACT)
A buyer who has concluded a distance contract has the right, without stating any reason, to unilaterally terminate the contract within 14 days from the date they (or a third party designated by them, who is not the carrier) took physical possession of the goods.
In order to exercise this right, the buyer must notify 3 kantuna of their decision to withdraw from the contract by means of a clear written statement sent to the email address shegava@shegava.com
or by postal mail to the seller’s address:
Obrt 3 kantuna
Braće dr. Sobol 33
51260 Crikvenica
Croatia
The buyer may also use the Model Withdrawal Form, which can be downloaded [from the website or requested via email].
The seller will confirm receipt of the withdrawal notice via email without delay.
If the buyer exercises the right to withdraw, they must return the goods to the seller without undue delay, and no later than 14 days from the date on which they informed the seller of their decision to terminate the contract.
The goods should be returned to the same address as above.
The buyer bears the cost of returning the goods.
Returned goods must be undamaged, unused, and in their original packaging, accompanied by the original invoice.
The buyer is responsible for any reduction in the value of the goods resulting from handling beyond what is necessary to determine the nature, characteristics, and functionality of the goods.
The seller will refund the payment received from the buyer, including delivery costs (except for any additional costs incurred if the buyer chose a delivery method other than the least expensive standard delivery offered by the seller), without undue delay and no later than 14 days from the date on which the seller received notice of the buyer’s decision to withdraw from the contract.
The refund will be made using the same means of payment used in the original transaction, unless expressly agreed otherwise with the buyer; in any case, the buyer will not incur any additional costs due to the refund.
The seller may withhold the refund until the goods have been returned or until the buyer provides proof that the goods have been sent back, whichever occurs first.
The right to withdraw from the contract does not apply in cases where:
goods have been made to the buyer’s specifications or clearly personalized,
goods are perishable or have an expired shelf life,
goods are sealed products that are not suitable for return for health protection or hygiene reasons and have been unsealed after delivery.
COMPLAINTS
In accordance with Article 10 of the Consumer Protection Act, the buyer may submit a written complaint about the purchased product or the quality of service.
Complaints may be submitted:
by email to shegava@shegava.com, or by postal mail to the address:
Obrt 3 kantuna
Braće dr. Sobol 33
51260 Crikvenica
Croatia
When submitting a complaint, the buyer must provide their first and last name, address, contact information (telephone number or email address), and a detailed description of the issue.
3 kantuna will acknowledge receipt of the complaint without delay, and a written response will be sent to the buyer within 15 days from the date of receiving the complaint.
If the complaint is justified, the buyer has the right to:
free repair,
replacement of the product,
price reduction, or
contract termination and refund, in accordance with the provisions of the Consumer Protection Act.
If a defect occurs on the product within the legally prescribed period of two years from the date of delivery, the buyer has the right to file a claim based on material defects.
The seller is not responsible for defects or damages caused by improper handling, wear and tear, mechanical damage, or improper maintenance.
In the event of a return due to a complaint, the buyer must first contact the seller via email.
After approval of the complaint, the product should be returned to the address above, together with the original invoice and a written description of the defect.
Complaints will not be accepted for products that show signs of use inconsistent with normal handling, or if damage has been caused by the buyer.
